Terms and Conditions
Terms & Conditions
These Terms & Conditions govern your use of print-it.com and purchases, quotes, projects, and services provided by Print It of South Florida, Inc. By using our website, submitting a quote request, approving a proof, placing an order, or otherwise purchasing products or services from us, you agree to these Terms.
1. Acceptance of These Terms
These Terms apply to your access to and use of our website and to orders, quotes, projects, products, and services provided by Print It of South Florida, Inc. Additional terms shown on a quote, invoice, proof, product page, credit agreement, or other project document also apply to the applicable transaction.
If there is a conflict between these Terms and a written quote, invoice, or agreement signed or expressly approved by Print It, the more specific written terms will control for that transaction.
We may update these Terms from time to time. The version posted when you place or approve an order generally applies to that transaction unless otherwise agreed in writing.
2. Quotes, Pricing & Orders
Quotes are based on the information available when the quote is prepared, including quantity, size, materials, artwork condition, finishing, shipping, turnaround, and other project specifications.
- A quote is not an acceptance of an order and may have an expiration date.
- Pricing may change if specifications, quantities, artwork, delivery requirements, taxes, material costs, or other project details change.
- Online pricing errors, typographical errors, or obvious system errors may be corrected before production begins.
- An order is accepted when we confirm or begin processing the order, receive required payment or credit approval, and receive any necessary artwork or proof approval.
We reserve the right to decline a project or order when reasonably necessary, including for capacity, payment, legal, safety, technical, content, or production reasons.
3. Artwork, Files & Customer Content
You are responsible for providing accurate, complete, and production-ready content and for reviewing the spelling, grammar, names, addresses, phone numbers, dates, prices, barcodes, QR codes, mailing data, images, and other information included in your project.
By submitting artwork, text, photographs, logos, trademarks, mailing lists, or other content, you represent that you own the content or have all rights, licenses, permissions, and authorizations necessary for us to reproduce, modify as needed for production, and use that content to complete your order.
You grant Print It a limited right to use the content you provide solely as reasonably necessary to quote, prepare, proof, produce, fulfill, ship, store, or otherwise complete the requested project.
4. Proofs & Approvals
When a proof is provided, you are responsible for reviewing it carefully before approval. Approval authorizes us to proceed based on the approved proof and project specifications.
Changes requested after approval may require a revised quote, additional charges, or a new production schedule. Once production has begun, changes may not be possible.
Digital proofs are intended primarily to confirm content, layout, position, and general appearance. Screen displays are not an exact representation of final printed color.
5. Production Standards & Reasonable Variation
Printing and manufacturing involve physical materials and production processes. Reasonable variation may occur between a proof, a prior order, and the finished product.
Examples may include reasonable variation in:
- Color, density, coating, texture, and appearance.
- Cutting, folding, scoring, binding, registration, and finishing.
- Paper, substrate, material, or manufacturer characteristics.
- Finished dimensions within normal industry tolerances.
- Quantities where an overrun or underrun is customary for the production method.
Material substitutions of comparable quality may occasionally be necessary because of availability. We will seek approval before making a substitution that materially changes the agreed product where reasonably practical.
6. Changes & Cancellations
Contact us as soon as possible if you need to change or cancel an order. Whether a change or cancellation is possible depends on the production stage.
- Orders cancelled before production may be eligible for a refund less work already performed, design charges, setup costs, transaction fees, purchased materials, or other nonrecoverable costs.
- Once printing, manufacturing, finishing, mailing, fulfillment, or other custom production has begun, the order may not be cancellable or refundable.
- Customer-requested changes may affect pricing and turnaround.
7. Returns, Defects & Claims
Most products we provide are custom-made to customer specifications and generally cannot be returned simply because the customer changes their mind.
If you believe an order is defective, damaged, short, or does not materially conform to the approved specifications because of our production error, please contact us promptly after delivery and preserve the product, packaging, photographs, and other information needed to evaluate the claim.
We may require return or inspection of some or all affected products before resolving a claim. If we determine that we are responsible for a material production error, our remedy may include, at our option and as appropriate, reprinting the affected product, providing a credit, or issuing a refund for the affected portion of the order.
Claims relating to customer-supplied artwork, approved proofs, normal production variation, misuse, improper storage, or damage occurring after delivery may not qualify for replacement or refund.
8. Payment, Taxes & Credit Terms
Payment is due according to the terms shown at checkout, on the quote or invoice, or in an approved credit agreement. We may require full or partial payment before ordering materials, beginning production, releasing finished goods, or shipping an order.
Applicable sales, use, shipping, or other taxes and charges may be added unless a valid exemption is provided and accepted.
Customers with approved credit terms must pay invoices when due. Past-due balances may be subject to finance charges, collection costs, suspension of credit terms, or other remedies stated in the applicable invoice or credit agreement, but not in excess of amounts permitted by applicable law.
9. Shipping, Delivery & Mailing
Shipping and delivery dates are estimates unless we expressly agree in writing to a guaranteed deadline. Production schedules may depend on timely receipt of payment, approved artwork, proofs, mailing data, materials, and other customer information.
We may arrange shipment through third-party carriers on your behalf. Carrier delays, weather, incorrect customer-provided addresses, customs processing, or other events outside our reasonable control may affect delivery.
Responsibility for loss or damage during shipment will be handled according to the applicable carrier terms and law. We will reasonably assist with carrier claims when appropriate.
Mailing projects may also be subject to postal-service rules, rates, acceptance procedures, delivery standards, and customer-provided mailing data. Postage and postal delivery timing are outside our direct control.
10. Warranty Disclaimer
We warrant that we will perform our production services in a commercially reasonable manner and will use commercially reasonable efforts to produce goods that materially conform to the approved project specifications, subject to normal production tolerances.
Except for any express warranty stated in writing and except to the extent a disclaimer is prohibited by applicable law, products and services are otherwise provided without additional express or implied warranties, including warranties of merchantability or fitness for a particular purpose.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Print It will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost revenue, loss of business, or loss of data, arising from or relating to a product, service, order, website use, delay, or these Terms.
To the fullest extent permitted by applicable law, our aggregate liability relating to a particular order or project will not exceed the amount actually paid to Print It for the affected order or portion of the order giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
12. Customer Content & Indemnification
You are responsible for the content you ask us to reproduce. To the extent permitted by law, you agree to defend, indemnify, and hold harmless Print It and its officers, employees, and service providers from third-party claims, damages, losses, and reasonable costs arising from customer-supplied content that allegedly infringes intellectual-property, privacy, publicity, or other third-party rights, or violates applicable law.
We reserve the right to refuse work that we reasonably believe is unlawful, fraudulent, infringing, defamatory, threatening, or otherwise inappropriate for production.
13. Events Beyond Our Reasonable Control
We are not responsible for delay or failure caused by events beyond our reasonable control, including severe weather, hurricanes, fire, flood, power or internet outages, labor disruptions, equipment failure despite reasonable maintenance, carrier or postal disruptions, material shortages, supplier delays, governmental actions, war, terrorism, civil unrest, epidemic, pandemic, or other similar events.
When such an event occurs, we will use commercially reasonable efforts to communicate material delays and resume performance when reasonably possible.
14. Website & Intellectual Property
The website and its original text, layout, graphics, software, functionality, branding, and other content owned by Print It are protected by applicable intellectual-property laws. You may use the website for legitimate personal or business transactions with us but may not copy, scrape, reverse engineer, reproduce, sell, or exploit protected website content except as permitted by law.
Customer-owned artwork and content remain the property of their respective owners, subject to the limited production rights described in these Terms.
15. Electronic Transactions & Communications
By using our website, creating an account, submitting an order or quote, approving a proof electronically, or otherwise conducting business with us electronically, you consent to the use of electronic records and communications for the applicable transaction to the extent permitted by law.
We may provide order confirmations, proofs, invoices, notices, and other communications electronically using the contact information you provide. You are responsible for keeping your contact information current.
16. Governing Law & Venue
These Terms and transactions with Print It are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where another law must apply as a matter of law.
Subject to any law that requires otherwise, legal proceedings arising from these Terms or a transaction with Print It will be brought in a court of competent jurisdiction located in Broward County, Florida, and the parties consent to jurisdiction and venue there.
17. General Provisions
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
Our failure to enforce a provision does not waive our right to enforce it later. Headings are for convenience only.
These Terms, together with the applicable quote, invoice, proof approval, order information, credit agreement, and any other written terms expressly incorporated into the transaction, constitute the agreement relating to that transaction and supersede inconsistent prior discussions regarding the same subject.
